Accidents at Work*

Holiday Accidents and Accidents Abroad*

Under the Package Holiday and Travel Trade Act 1995, if you have suffered a personal injury as a result of an accident abroad whilst on an organised package holiday, you can successfully bring a claim for personal injuries against the Company or Tour Organiser who organised your holiday, provided you can show they were negligent. Tour Organisers have a duty of care to ensure that the accommodation being provided is safe and hygienic. The most common types of accidents that occur while on holiday are slip and fall type accidents (particularly around swimming pools), injuries arising from unhygienic conditions and food poisoning.

Accidents where an Infant or Minor has Suffered Personal Injury*

The Courts consider people under the age of eighteen to be minors. If an infant or minor has suffered personal injury as a result of an accident while they are under the age of eighteen, it is necessary for an adult (usually their mother, father, grandparent or elder sibling) to take action on their behalf and act as their next of friend. Any compensation awarded as a result of the accident will then be lodged in Court until the injured party reaches the age of majority. Once the settlement monies have been lodged in Court they will accrue Courts Act Interest at a rate of 8% per annum.

Fatal Injuries*

If someone dies due to the negligence of a third party, the deceased’s dependants can take an action against the third party. Only one action can be brought against the same third party and it must be brought on behalf of all the deceased dependants. The dependants can make a claim for mental distress arising out of the death however the collective limit of such damages is capped at €25,395.00. The dependants can also make a claim for pecuniary loss, such as loss of earning or entitlements, which the dependants could have reasonably expected to receive, had the deceased not died.

Bullying and Harassment Personal Injury Claims*

It you have been subjected to bullying or harassment in the work place you may have a claim for personal injuries against your employer. The Personal Injuries Assessment Board*

All claims for Personal Injuries arising out of the negligence of third parties must first be submitted to the Personal Injuries Assessment Board (PIAB).  The Personal Injuries Assessment Board (PIAB) can only assess claims where liability is not at issue.  At Hanahoe and Hanahoe solicitors we will submit your application and lead you through the PIAB process. Most importantly however, we will value your claim and advise you whether or not to accept the Assessment made by the Personal Injuries Assessment Board. Where we advise a client to reject the Assessment, we can never guarantee them that we will obtain more compensation by issuing proceedings, however to date we have never failed to better the rejected Assessment.

Asbestos and Mesothelioma Cases*
